PariBloom Terms of Service

These Terms of Service ("Terms") are an agreement between you and PARINEST TECHNOLOGIES LLP ("PariNest," "we," "us") about your use of PariBloom (the "App"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.

What PariBloom is
PariBloom is an offline communication app that helps nonverbal and minimally-verbal people express themselves using photo tiles and text-to-speech. A caregiver usually sets up and manages the App, including through Caregiver Mode.
Not a medical or therapy service
PariBloom is a communication tool. It is not a medical device, a diagnostic tool, or a substitute for assessment, advice or treatment from a speech-language pathologist, doctor or other qualified professional. Do not rely on the App as the only way for a person to communicate in an emergency or to make their needs known where their health or safety is at risk.
Who may use the App
The App may be used by people of any age under the setup and supervision of a caregiver. Only an adult (18 or older, or the age of majority where you live) may buy a subscription or agree to these Terms on behalf of another person. If you set up the App for someone else, you confirm you are entitled to do so.
Free trial
Each profile gets a 30-day free trial starting when you first start using PariBloom with that profile. The trial is provided by the App itself. It needs no payment, card or account, and it is separate from any trial run by Google Play or the App Store. After the trial ends, the ready-made items in the PariBloom Content Library need PariBloom Premium. Everything you create yourself, including your own categories, photos and phrases, stays free, as do Emergency Help, About Me, text-to-speech, and Export and Import. We may change or end the trial offer for future users.
PariBloom Premium subscription
- Plans. PariBloom Premium is an auto-renewing subscription, available monthly or annually.
- Price. The price for your country, including any taxes the store adds, is shown in the App and in Google Play or the App Store before you confirm a purchase.
- Payment. Payment is taken by Google Play (Android) or Apple (iOS). We do not receive or store your payment details.
- Renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your account may be charged for the renewal within 24 hours before the period ends, at the price shown when you subscribed.
- Managing and cancelling. On Android, open Google Play, then Payments and subscriptions, then Subscriptions. On iPhone or iPad, open Settings, tap your name, then Subscriptions. Deleting the App does not cancel a subscription.
- Refunds. Refund requests for purchases made through Google Play or the App Store are handled under that store's policies. We may not be able to issue refunds ourselves.
- Restoring purchases. If you reinstall the App or change devices, use Restore Purchases in the App to recover an active subscription.
- Price changes. If we ever change the price of a subscription, the store will notify you as required, and the change will not apply to you until you have had the chance to accept it or cancel.
Your content and your data
Photos, text, profile details and your Caregiver Mode PIN are created and stored on your device. We do not receive them. You are responsible for the content you add and for having the right to use it. Do not add anything unlawful or that infringes someone else's rights.
Because nothing is stored in the cloud, deleting the App, losing your device, or resetting it may permanently delete your content. Use the Export feature in Caregiver Mode to make backups, and keep them somewhere safe. Keep your Caregiver PIN safe as well. We cannot recover or reset a forgotten PIN. Regaining access may require reinstalling the App, which removes the content stored on your device, so keep an exported backup.
Licence and acceptable use
We give you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose. You agree not to copy, modify, resell or reverse engineer the App except where the law allows it, and not to use the App to harm others or break the law.
Availability and updates
We work to keep the App reliable but do not promise it will always be available or error-free. We may update the App or change its features. Text-to-speech voices come from your device's operating system, so voices, languages and quality vary by device and are outside our control.
Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, PARINEST TECHNOLOGIES LLP is not liable for indirect, incidental or consequential damages, or for any loss or harm arising from your use of, or inability to use, the App, including loss of data. Our total liability to you for any claim is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
Ending your use
You may stop using the App at any time by deleting it and cancelling any subscription in the store. We may suspend or end access for anyone who breaks these Terms.
Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the App or by email before they take effect. Continuing to use the App after a change means you accept the new Terms.
Additional terms for iOS users
These terms apply if you download the App from Apple's App Store.
- These Terms are between you and PariNest only, not Apple. PariNest, not Apple, is solely responsible for the App and its content.
- Your licence is limited to use on Apple-branded products that you own or control, as permitted by Apple's Media Services Terms and Usage Rules.
- PariNest, not Apple, is solely responsible for maintenance and support of the App. Apple has no obligation to provide them.
- If the App fails to meet an applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the App. Any other claim, loss or cost relating to a failure to meet a warranty is PariNest's responsibility.
- PariNest, not Apple, is responsible for addressing claims about the App, including product liability, legal or regulatory compliance, and consumer protection.
- PariNest, not Apple, is responsible for investigating and defending any third-party claim that the App infringes intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you.
